1. Introduction
These Terms and Conditions govern the provision of the coaching program offered by Electric Feel Co. ("the Company", "we", "us", "our"), owned by Alison McGrath, ABN 93 582 139 607. By enrolling in our coaching program, you ("the Client", "you") agree to be legally bound by these terms.
2. Program Enrollment and Payment
2.1 The coaching program is only available as a full upfront payment unless otherwise negotiated with Electric Feel co.
2.2 Payment must be received by the Company prior to the commencement of the program for the paid in full option.
2.3 For the payment plan option, the Client agrees to pay in agreed upon installments, commencing on the program start date and continuing thereafter.
2.4 Failure to complete payments may result in suspension from the program, without relieving the obligation of the remaining owed payments.
3. Intellectual Property
3.1 All materials provided during the course of the coaching program, including but not limited to videos, documents, worksheets, and any other intellectual property, are the exclusive property of Electric Feel Co.
3.1b The Art of Seduction by Robert Greene is referenced in some of our teachings to illustrate strategies and techniques related to personal branding and influence. While these principles are discussed for educational purposes, Electric Feel Co. does not stake claim to the intellectual property of Robert Greene, the Art of Seduction or the original intent of the Seduction Archetypes.
3.2 The Client is granted a non-exclusive, non-transferable license to use the provided materials for personal and non-commercial use only.
3.3 The unauthorized distribution, reproduction, or commercial use of any materials provided in the program is strictly prohibited.
4. Consumer Rights
4.1 Nothing in these Terms and Conditions is intended to limit any rights you have under the Australian Consumer Law.
4.2 If the coaching program is not provided with due care and skill or as agreed, you may be entitled to a range of remedies including, but not limited to, a partial or full refund, depending on the circumstances.
5. Cancellation and Refunds
5.1 Requests for cancellation of the program by the Client must be made in writing.
5.2 Given the nature of the program, refunds are generally not provided once the program has commenced. However, the Client retains the right to seek a remedy under the Australian Consumer Law if the service is not rendered with due care and skill.
6. Limitation of Liability
6.1 To the maximum extent permitted by law, Electric Feel Co. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.
6.2 Our liability in connection with the coaching program, regardless of the form of action, shall not exceed the total amount paid by the Client for the program.
7. General
7.1 These Terms and Conditions may be amended by Electric Feel Co. from time to time. Such amendments will be effective upon posting on our website or by direct communication to you.
7.2 These Terms and Conditions shall be governed by and construed in accordance with the laws of Australia.
